MJ’s Timeline Reloaded- 2009 part 2

By The Last Tear
  • May 4/5/6:

Michael goes to Dr Klein’s in Beverly Hills.

  • May 5:

Raymone Bain, Michael’s former manager and spokesperson, files a lawsuit in Washington D.C claiming breach of contract; quantum merit and unjust enrichment and she asks for 44 millions $.

Dr. Tohme Tohme is officially terminated as Michael’s manager and disbarred from having any subsequent affiliation with him or any of his numerous established entities (including MJJ Productions and the newer MJJ Kingdom). Michael hires Frank Dileo as his new manager.

Even if Tohme was a go-between for Thomas Barack-AEG-AEG Live and Michael, it seems that at the beginning of 2009 they had wanted to get rid of him. We know that Michael was looking for a way to fire Tohme (re June Gatlin’s record as we saw earlier). When the opportunity came up Michael replaced him with Dileo.

As we also know, Tohme did not disappear. He was still around and on June 25th as he was at the hospital talking to the media as Michael’s manager. It was not until later, when the Estate of MJ was established that Tohme was finally dismissed. He even returned 5.5 million dollars belonging Jackson to the Estate (Read this article).

One of the mysteries is Tohme himself. We don’t know who he really is and what he did to Michael. Who did in the first place push Tohme forward? The reason he could stay even after MJ’s passing was probably that he had an understanding and / or a contract with some people involved with MJ. But who?

I hoped people who had the answers, would help us to finally solve this mystery.

My wish was granted by none other than the Estate of Michael Jackson. In fact, on Feb. 17th 2012, The Estate sent a petition against Tohme Tohme to the Superior Court for the State of California. In this petition, the executors of the Estate explain how Tohme stole from Michael and acted to try and ruin him. Read this document here

  • May 8:

AEG hires Dr. Conrad Murray as Michael’s personal physician.

We have heard about a contract for services (CM’s contract) drafted by lawyer Katty Jorrie. AEG asked her law firm to write this document. However the contract was never signed either by MJ or AEG Live.

Here it’s Katty Jorrie’s testimony on day 2 of the trial:

Here Jorrie explains that the insurance company needed 5 years of MJ’s medical history. It was on June 23 and she informed Murray about this. He said that he had been Jackson’s doctor for 3 years. Later on June 24, he contacted his office to get some false and some true records. Also Jorrie connected Murray to Bob Taylor, the insurance broker. Taylor sent a message to Murray on June 25.

Katty Jorrie gives us two important pieces of information:

Firstly, she tells us how she connected Murray with the insurance broker Bob Taylor meaning that AEG Live knew about it and approved it.

Secondly, she tells us about Murray’s contract which had a peculiar form: Murray’s boss, the one who had hired him, was AEG Live but the one who would pay him was Michael Jackson. So Murray had double green lights; AEG secured his position. However he was unsure about Michael! Therefore he did what he did on May 10th!

  • May 10:

Murray records MJ coherent but while apparently sedated.

Michael’s talk:

MJ: Elvis didn’t do it. Beatles didn’t do it. We have to be phenomenal. When people leave the show, when people leave the show, I want them to say, “I’ve never seen nothing like this in my life. Go. Go. I’ve never seen nothing like this. Go. It’s amazing. He’s the greatest entertainer in the world”. I’m taking that money, a million children, children’s hospital, the biggest in the world, Michael Jackson’s Children’s Hospital. Gonna have a movie theatre, game room. Children are depressed. The – in those hospital, no game room, no movie theatre. They’re sick because they’re depressed. Their mind is depressing them. I want to give them that. I care about them, them angels. God wants me to do it. God wants me to do it. I’m gonna do it, Conrad.

CM: I know you would.

MJ: Don’t have enough hope, no more hope. That’s the next generation that’s gonna save our planet, starting with – we’ll talk about it. United States, Europe, Prague, my babies. They walk around with no mother. They drop them off, they leave – a psychological degradation of that. They reach out to me – please take me with you.

CM: Mmnh-mmnh.

MJ: I want to do that for them.

CM: Mmnh-Mmnh.

MJ: I’m gonna do that for them. They will be remembered more than my performances. My performances will be up there helping my children and always be my dream. I love them. I love them because I didn’t have a childhood. I had no childhood. I feel their pain. I feel their hurt. I can deal with it. Heal the World, We are the World, Will You Be There, The Lost Children. These are the songs I’ve written because I hurt, you know, I hurt.

(13 seconds: silence)

CM: You okay?

(8 seconds: silence)

MJ: I am asleep

The prosecutor David Walgren and the judge Michael Pastor enlightened the jury and the world why Murray secretly taped Michael in such a condition. The tape was a “security” for Murray to keep his 150 k $ in case MJ wanted to fire him.

He said he needed stronger lidocaine cream, requested 4% and again discussed an energy formulation. He placed an order. Lopez offered to deliver to him in Santa Monica, Murray said ship it. • June 11:

Michael invites several fans on the set of Thriller 3-D in Culver Studios.

  • June 13 or 14:

Michael calls Dr. Klein office and ask if they know any anesthesiologist.

Michael wished to hire an anesthesiologist. Thanks to Murray, Dr. Adams could never get close to MJ. This shows again that Michael did not trust Murray and wanted a specialist to be there with him. This also reconfirms Dr. Treacy’s statement about Michael.

It was in an interview with TMZ that Dr. Klein talked about this phone call (Read vmj’s post here)

  • June 15:

The 9th week of rehearsals begins at the Forum

Another order was sent from Murray to Lopez:

1 tray of 10-10 mL vials of lorazepam 2 trays of 10-2 mL vials of midazolam 12-1 L bags of normal saline Gatorgirl http://tl.gd/dbpsl2

Conrad Murray sent a goodbye letter to his ex patients:

One of the prosecution’s witnesses was Robert Russell, an ex patient of Murray’s (Day 4 of the trial). During his testimony, Robert Russell explained that Murray revealed his plans – following Michael to UK as MJ’s private doctor – before telling the news officially to his staff (part 3, 12:44- 15:10). Russell explained also that he felt he was being abandoned later by Murray who did not follow him up and that he felt neglected because Murray had not referred him to another doctor (part 4, 6:20-6:45, part 5 3:57-6:08).

Later the defense called in (day 18 of the trial) several patients who testified how Murray had saved their lives and how good he was to them. We heard that Murray worked pro bono and had one of his offices in a poor neighborhood; actually he took over his father’s practice at this low income community. Certainly, these ex patients and friends had wanted to help Murray but with their testimonies they also help us to understand how Murray maliciously intended to secure the position of “MJ’s private doctor” for himself, as he wrote in his letter this “ once in a life opportunity”.

Imagine Michael hearing that the doctor who occasionally treated him and his children, worked also pro bono at a large community where 70% of the people were / are poor; think also that MJ heard that Murray paid sometimes even for his patients’ medications along with all the other stories that the ex-patients told on the court.

Then one day Murray comes along with his pregnant girlfriend (Nicole Alvarez) just to show Michael how he loved children, and how he wanted to be a “good” father and so on.

It is not difficult to understand why Michael wanted him to be his doctor, why this “perfect” appearance was convincing at least at the beginning of their interaction as patient and doctor.

Who would believe that Murray even though he was married, had several girlfriends living in different places and searched actively for new relationships; who would believe that he had an unknown number of children whom he did not and still does not support financially? If he was a pro bono guy, why would he asked for $ 5 million as soon as the opportunity arose? Who would believe that Murray was capable of sedating Michael and taping him secretly; and finally killing MJ?

Concerning the sedation and the secret taping on May 10th, there is a parallel to be drawn. Several years ago something similar happened to Michael. In fact, during the last weekend of May 1993 when Michael was visiting Evan Chandler, the dentist called his colleague, an anesthesiologist, Mark Torbiner, to drug Michael under the pretext of curing MJ’s bad headacke. Both Chandler and Murray had made a plan to extort, threaten and blackmail MJ.

Being set up by many greedy people who surrounded him, Michael had learnt especially after 2005 not to entirely trust anyone. Even when he allowed people the chance to get close to him, he also observed them as he knew they might change their colors. Murray’s interactions with AEG Live, especially a few days before June 25th, showed Michael his true colors. This is probably why Jackson did not sign Murray’s contract.

  • June 16:

Michael goes to Dr Klein’s in Beverly Hills.

This week, local D.C. attorney Henry W. Asbill of Dewey & LeBoeuf LLP appeared in court to represent Michael Jackson against the charges filed by Raymone Bain. Also, three additional attorneys from the New York firm have been arranged to help work on the case pro hac vice (as they aren’t legally licensed to practice law in D.C.) alongside Mr. Asbill, including Frank C. Salzano, Donna L Gordon, and most notably L. Londell McMillan. It is now expected that a response to the suit will be filed before the 10-day default notice is up–later this week, and that no default judgment will be awarded.

  • June 17:

John Branca meets with Michael & Frank Dileo during rehearsals at The Forum and they talk about working together again.

  • June 18:

Michael does not show up at rehearsals. Randy Phillips goes to Michael’s house at 100 Carolwood Way, Beverly Hills in the presence of Dr Murray and they demand Michael to stop seeing Dr Klein and stop taking the drugs Dr Klein gives him.

Michael finally goes to the rehearsal at the Forum at 9:30 pm visibly shaken.

  • June 19:

During the last day of rehearsal at the Forum, Michael seems upset, not coherent, drugged and disoriented so following Kenny Ortega’s suggestion he decides to go back home in order to rest.

  • June 20:

On this day, Kenny Ortega sent his famous email to Randy Phillips at 2:04 am:

I will do whatever I can to be of help with this situation. If you need me to come to the house, just give me a call in the morning. My concern is now that we’ve brought the doctor into the fold and have played the tough love, now or never card is that the artist may be unable to rise to the occasion due to real emotional stuff. He appeared quite weak and fatigued this evening. He had a terrible case of the chills, was trembling, rambling and obsessing. Everything in me says he should be psychologically evaluated. If we have any chance at all to get him back in the light. It’s going to take a strong therapist to help him through this as well as immediate physical nurturing. I was told by our choreographer that during the artists costume fitting with his designer tonight they noticed he’s lost more weight. As far as I can tell there is no one taking care responsibility (caring for) for him on a daily basis. Where was his assistant tonight? Tonight I was feeding him, wrapping him in blankets to warm his chills, massaging his feet to calm him and calling his doctor. There were four security guards outside his door, but no one offering him a cup of hot tea. Finally it’s important for everyone to know, I believe that he really wants this. It would shatter him, Break his heart if we pulled the plug. He’s terribly frightened it’s all going to go away. He asked me repeatedly tonight if I was going to leave him. He was practically begging for my confidence. It broke my heart. He was like a lost boy. There still may be a chance he can rise to the occasion if we get him the help he needs

Sincerely, Kenny

Later on this day, a meeting takes place at Michael’s house in presence of Dr Murray, Randy Philips & Kenny Ortega.

  • June 21:

Michael spends father’s day with Prince, Paris & Blanket and he also calls

the Cascio family & the Lester family but in the afternoon he feels sick and calls his nurse Cherilyn Lee.

We know that Cherilyn Lee had talked to Michael about Propofol and it’s side effects. When MJ felt sick, he recognized these effects and called Lee. Unfortunately she was not in LA. In the past and on the few occasions that Propofol had been administrated to Michael, an anesthesiologist had always done the job (for example the dental procedures in 2008) and MJ would not have experienced the side effects of Propofol. Calling Cherilyn Lee shows that MJ did not trust Murray, that he understood Murray and his “care” had sickened him; knowing this, why on earth would Michael allow Murray to use his “treatment” in the coming nights?

  • June 22:

For the last time Michael goes to Dr Klein’s in Beverly Hills.

  • June 23:

Michael & the TII team start rehearsing at the Staples Center in L.A

  • June 24:

Last day of Michael’s life and last day of rehearsals at the Staples Center.

  • June 25:

1:30 am: After completing his last rehearsal at Staples Center Michael arrives at his home, 100 North Carolwood Drive in the Holmby Hills district of Los Angeles.

About what happened later on June 25, we cannot refer to what Conrad Murray said to the police. He probably fabricated most of it.  The hours between 1:30 am and after 10 am – when Murray went to the kitchen asking Kaj Chase to bring Prince into MJ’s room – are unknown. Hopefully, one day we will know the truth.
